Copyright Policy
Purpose
The purpose of this document is to:
- Ensure that Web Elegance and people who represent this organisation adhere to the provisions of the Copyright Act 1968 (Cth.).
- Provide the information to our clients about Web Elegance copyright practice.
- Protect the material developed and designed by Web Elegance and our stuff members, including the materials presented on Web Elegance website.
- Protect copyright rights of our clients and third party authors of any materials used for projects developed by Web Elegance.
- Identify and outline the procedures for copyright ownership transfer, wherever appropriate.
Information about legislation and standards
Web Elegance and all the people who represent our organisation adhere to the Copyright Act 1968
(Cth.).
The current copyright standards for the industry, details on the rules and procedures for copyright transfer and authorship right are outlined in Australian Copyright Council.
All the materials and component parts of all the projects developed by Web Elegance, such as
video clips, text, artworks, logos, tables, photographs, music and files are protected by copyright.
The underlying source code and files may be protected by the copyright.
The websites as a whole or ideas presented on the websites are not protected by copyright.
The ownership and the copyright of the projects developed by Web Elegance for our clients is determined on the bases of authorship of the materials and components used for the design and development of a project.
Use of material
Web Elegance respects the rights of all clients, authors and copyright holders. Subject to the Copyright Act 1968 (Cth.) one must not make use publicly or commercially of any material protected by copyright unless a permission (license) is obtained to do so.
Copyright and ownership of materials authored by the clients of Web Elegance belong to the
author of these materials.
An agreement between Web Elegance and a client implies the right to use materials obtained from
the client in order to complete the project requested by the client.
Web Elegance will not use or publish third party materials without appropriate permission to do so.
For all the materials and components obtained from the third party for the projects developed by Web Elegance a licence or a copyright ownership transfer must be obtained from the author or the owner of the copyright of the materials or components used.
However you or your organisation may use any of the Web Elegance material developed or presented on our website for your personal, non-commercial use or use within your organisation for non-commercial purposes, provided that an appropriate acknowledgement is made, and the material is not altered or subjected to derogatory treatment.
There are certain cases when the license or permission is not required, such as:
- if material is not covered by copyright (for example: ideas, information or some names, unless they covered by other areas of the law);
- if copyright has expired (for example if a photograph was taken before 1955);
- if you are not using a substantial part of work;
- when your use of the material is a fair dealing for criticism or review, for reporting news, or for parody or satire.
There are also some cases when you may not need to obtain copyright directly from the owner, for example when the copyright statement is already included in the content material (for example in PDF files or text, etc).
